Can Same Sex Couples Get Divorced in Ohio?
In the case of Obergefell v. Hodges, the Supreme Court of the United States answered this question in the affirmative with its 5-4 landmark decision. In its decision, the Supreme Court of the United States held that same-sex couples are entitled to the fundamental right to marry under the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution.
As a logical consequence of the right to marry, same-sex couples are now entitled to end marriages through the divorce or dissolution process in Ohio.
